Terms and Conditions

General Terms and Conditions for the auto motor und sport Congress

Scope

These General Terms and Conditions apply to participation in the “auto motor und sport Congress 2025” at the Mercedes-Benz Museum in Stuttgart.

The event consists of two separate event days and will take place from October 13, 2025, to October 14, 2025.

Part 1:
October 13, 2025: Tech Conference, Evening Event

Part 2:
October 14, 2025: auto motor und sport CONGRESS

These General Terms and Conditions apply exclusively. Any deviating or supplementary general terms and conditions of the purchaser shall only become part of the contract if we have expressly agreed to their validity in writing.

The contract is concluded between the organizer Motor Presse Stuttgart GmbH & Co. KG (hereinafter referred to as the “Organizer”) and the customer.

vivenu GmbH, Kesselstrasse 3, 40221 Düsseldorf, Germany (“vivenu”) provides software and related services (“vivenu Services”) that enable providers or operators of artistic, cultural, sporting, or other events—such as performances, concerts, meetings, seminars, leisure activities, museums, film screenings, readings, trade fairs, conferences, educational courses, and other occurrences (physical or virtual)—to sell tickets and manage related transactions with end customers. vivenu is a technology platform provider for the Organizer. vivenu is not a ticket broker and is not the organizer of any event.

Motor Presse Stuttgart GmbH & Co. KG has commissioned vivenu GmbH, Kesselstrasse 3, 40221 Düsseldorf to handle ticket sales for the auto motor und sport CONGRESS.

When you order tickets for the Congress, you will be redirected to the vivenu platform. To complete the order, a form must be filled out, requiring personal data such as your first and last name, email address, and mailing address. vivenu stores and processes this data to process the order and forwards it to us.

Payments are processed via payment service providers integrated by vivenu.

We have concluded a data processing agreement with vivenu in accordance with Art. 28 GDPR.

Conclusion of Contract

By successfully completing a purchase through vivenu Services, a contract is formed solely between the Organizer and the end customer. This also applies when tickets or services are labeled with “powered by vivenu” or sold via vivenu’s domains and subdomains (vivenu.com). No purchase or service contract is concluded between the customer and vivenu.

There is no entitlement to conclude a contract with the Organizer. The end customer acknowledges that the Organizer may make the conclusion of a contract conditional on accepting additional terms, privacy policies, revocation notices, or other provisions, including restrictions (e.g. max. number of tickets per person). The Organizer and vivenu (on behalf of the Organizer) reserve the right to reject a purchase without giving reasons.

The total purchase price is determined solely by the Organizer and may exceed the price printed on the ticket or listed in the ticket shop due to additional fees or taxes. The final price will be shown before the purchase is completed and must be paid using the available payment options.

A contract between the Organizer and the customer is only concluded upon confirmation from vivenu (on behalf of the Organizer), such as by sending a transaction confirmation or providing a ticket with a valid ID. Completing the order process alone does not entitle the customer to participate in the event.

If technical issues lead to overselling (total or category-based), the Organizer or vivenu will inform affected customers and cancel tickets with a refund of the full amount paid.


Ticket Form

Unless otherwise communicated, the customer will receive a confirmation email and a separate email with a link to the purchased ticket(s). The required form (PDF, digital wallet, etc.) will be specified and must be presented at the event. A confirmation email alone is not sufficient for entry.

If offered by the Organizer, printed and mailed “hard tickets” may be ordered for an additional fee.

The customer is responsible for verifying the correctness of the tickets upon receipt (e.g., quantity, price, date, venue). Errors must be reported within five working days.

Ownership of the ticket only transfers after full payment has been received.

The customer must provide accurate and complete information during purchase. The Organizer or vivenu may verify this information, e.g., via a credit check.


Rights and Obligations

All relevant event details (e.g., content, location, time, pricing, restrictions, ticket form, accessibility, seating plans, house rules) will be communicated by the Organizer or vivenu (on the Organizer’s behalf).

These are acknowledged by the customer and are part of the contract.

It is the customer’s responsibility to ensure they meet all conditions and rules for participation. The Organizer may refuse or end attendance if these are not met.

In cases of suspected abuse, fraud, or violations, the Organizer or vivenu may invalidate tickets and deny or revoke admission without compensation.

Loss, damage, or seizure of tickets must be reported immediately. If the customer loses a hard ticket, the Organizer is not obligated to replace it.

Unless otherwise agreed, tickets are valid only for the specified event, date, location, and seat/category. After the event, the ticket expires.

The customer acknowledges that vivenu is not responsible for event execution or content. vivenu is not obligated to oversee, verify, or update event-related content or the Organizer’s responsibilities.

vivenu does not guarantee uninterrupted access to its services. Maintenance work may cause temporary disruptions.


House Rules

Participation in the event is subject to the house rules of the Mercedes-Benz Museum. These are binding and acknowledged by the customer. Violations may result in removal from the premises.

The Organizer is not obligated to replace lost tickets.


Cancellation, Refunds, Exchanges

There is no right of withdrawal, cancellation, exchange, or return for purchased tickets (§ 312g Abs.2 Nr. 9 BGB). All purchases are binding once completed.

However, a substitute participant may be named free of charge. This can be done via the ticket confirmation by personalizing the ticket again. Tickets transferred to non-subscribers lose the 10% discount.

Abuse of subscriber benefits may result in a retroactive charge.

Cancellation or Modification of Event

If the event is cancelled due to unforeseen circumstances (e.g., force majeure), the Organizer will refund the ticket price.

The same applies if the event differs significantly from what was advertised.

No further claims (e.g., for travel or accommodation costs) will be accepted.


Advertising

We use your email address to inform you about similar products or services. You will be informed of this at the time of contract conclusion. You can unsubscribe anytime free of charge via the link in the email or at info@ams-kongress.de.


Photo and Video Recordings

Please note that photo and video recordings will be made during the event. These may be used for reporting or promotional purposes by third parties, including digital media and the press.


Liability

The Organizer is only liable for damages in cases of intent or gross negligence.

In the case of simple negligence, liability is limited to:

  • injury to life, body, or health
  • property or financial damage due to breach of essential contractual duties (those necessary for proper contract performance).

In such cases, liability is limited to foreseeable, typical damages.

These limitations do not apply in cases of fraud, assumed warranties, or claims under the Product Liability Act.


Final Provisions

German law applies, excluding international private law and the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection laws remain unaffected.

For EU-based customers:
The customer confirms they have full legal capacity or proper authority to conclude the contract.

The European Commission provides a platform for online dispute resolution at http://ec.europa.eu/consumers/odr/.
The Organizer and vivenu are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
